For many people, a car is one of their most important belongings. If you are behind on your payments and you are worried your car is going to get repossessed, then call the Bankruptcy Law Center of Thomas R. Burns immediately to learn about your legal options. Often, if we act in time, we can save your car and prevent the major inconvenience of a repossessed car, not to mention the employment troubles that may arise from not having a reliable form of transportation.

Even if you plan on letting go of the car because it is too expensive, a bankruptcy will allow you the time to do that on your own terms.

Avoid Repossession

A Chapter 13 bankruptcy can allow you to keep your car in two ways. The first way is called a repayment plan. The repayment plan allows you to take your missed car payments and roll them into future repayment plan installments.

The second way is called a “cramdown.” In some cases, The Chapter 13 bankruptcy allows you to modify your car loan so that you only pay what the car is worth. So if you currently owe $10,000 on a car and it is only worth $7,000, then a “cramdown” will make it so you only pay $7,000 for it and the other $3,000 is eliminated.
